TEORI HAK CIPTA DAN PERTIMBANGAN KEPENTINGAN UMUM (AL-MASALIH AL-MURSALAH): ANALISIS TERHADAP MODEL ‘PUBLIC JOINT-AUTHORSHIP’

Abstract


Kepentingan umum menjadi pertimbangan utama dalam usaha mencapai keseimbangan antara perlindungan hak cipta dan akses orang awam terhadap karya-karya berhakcipta. Ketidakseimbangan telah mendesak cendiakawan undang-undang hak cipta bagi mencadangkan teori alternatif, termasuklah model ‘Public Joint-Authorship’. Kertas ini bertujuan untuk menganalisis kesesuaian model alternatif tersebut dengan Islam menggunakan kaedah pertimbangan kepentingan umum (al-Masalih al-Mursalah). Hasil kajian mendapati bahawa model ini mampu mencapai kepentingan umum menurut Islam, walaupun dengan beberapa perbezaan terutama dari sudut kerangka epistemologi.
